Prevention is better than cure

Martin Callaghan, Senior Manager in BDO’s Tax Dispute Resolution team, has authored an article in the December issue of the STEP Journal which looks at the newly introduced rules which are cracking down on the facilitation of tax evasion.

The legislation, introduced within the Criminal Finances Act 2017, applies to all UK businesses and partnerships, but can also apply to foreign corporates with some connection to the UK.  It also applies to charities. The organisation will have a strict criminal liability for its ‘failure to prevent’ the facilitation offence unless it can prove the defence of having had ‘reasonable prevention procedures’ in place.
