COVID-19 spotlight

The COVID-19 pandemic has caused economic losses for a huge number of businesses. Many of those businesses have made claims under their Business Interruption (BI) insurance. Insurers, having previously rejected claims on a number of grounds, were taken to the High Court by the FCA. The FCA brought this test Case against eight insurers to seek clarity as to whether certain non-damage wordings would give rise to cover.

The High Court and subsequently the Supreme Court largely ruled in favour of the FCA on behalf of policyholders with up to 370,000 policyholders potentially qualifying for a BI insurance pay-out.

Our guide on Business Interruption Insurance Claims considers some practical steps concerning awareness, quantification and utilisation of the BI insurance pay-out’s.
